# 6 透明度和問責機制必須建立在法律、內容限制政策，和實務做法中

1. 政府必須及時以易存取的格式在線上公布所有與中間人責任相關的法律、政策、決定及其他形式的規定。
2. 政府不得使用非司法措施對內容進行限制。這包括間接施壓強迫更改服務條款，推動或執行所謂「自律」的做法，以及達成限制交易或限制公開傳播內容的協議。

7. 政府、中間人和公民社會應該共同努力建立和維護獨立、透明、公正的監督機制，以確保可對內容限制政策與實務做法進行問責。
8. 應於中間人責任框架和法律中，要求就規定及指引進行定期、系統性檢視，以確保它們為最新、有效，且不過分繁瑣。這類定期檢視應納入有關其執行情形及影響的證據蒐集機制，並應制定規章，對它們的代價、實質利益，及人權影響進行獨立審查。
